Credit Card Defense

The average credit card debt of all households is over $8,000 and 28% of debtors say paying off their credit cards has recently become more difficult. This number is likely to rise as more people find themselves unemployed. At the same time, many banks are cutting credit limits and increasing interest rates at alarming speeds. All of this points to more people facing problems with debt collection agencies. In fact, experts claim that the debt collection industry will grow 23% in the next 7 years.

When debt collectors find their phone calls and letters are not working and you do not pay the debt they have secured (which they usually bought from your original creditor for mere cents on the dollar), they may file a lawsuit. Debt collectors usually win these lawsuits not because they are owed money, but because the defendant fails to respond, resulting in a default judgment in the collector’s favor.

Don’t let this happen to you, fight back with an experienced San Antonio credit card defense attorney. When you hire us to represent you in a debt collection trial, we will do everything in our power to minimize the amount you owe –and in some cases, we may have the debt erased altogether. Once we are on the case we will:

  • Help you answer the lawsuit with a legitimate affirmative defense explaining why you have not paid the debt.
  • We will then make the debt collector prove what you owe. These agencies rarely have access to all of the signed receipts detailing the amount you owe. When they can procure the receipts, we will review them all to ensure they bear your signature. The collectors will also need to show how your interest was calculated, using the original contract you signed with the credit company.
  • We will also make the debt collectors prove that they have the right to collect your debt. The paper trail connecting your original debt and the current collector must clearly indicate that this collector has the right to sue you. Additionally, they must prove that the debt is still standing and not outside the statute of limitations, which is only 4 years in Texas.

Our credit card defense is affordable and can greatly reduce, if not completely erase, the debt you owe. If you have any questions, call The Law Firm of David Canales to schedule a consultation with a skilled San Antonio credit card defense lawyer.
